BITO's PRIVACY POLICY

Your privacy matters to YTORIDE TRANSPORTATION (OPC) PRIVATE LIMITED (the “Company”, “we”, “YTORIDE”, “us” or “our”).

At YTORIDE TRANSPORTATION (OPC) PRIVATE LIMITED, your privacy is important to us. This Privacy Policy outlines how we handle the collection, use, processing, storage, retrieval, disclosure, transfer, and protection of your information, including personal information and sensitive personal data or information ("Information"). We collect this Information through your online interactions with the BITO mobile application ("BITO App") or our website at https://bito.org.in/ (together referred to as the "BITO Platform"), as well as through your offline interactions with us. This includes communication via mail, phone, in-person meetings, and while using our services.

When we mention "you" or "your" in this Policy, we refer to Pilots (as defined below), Customers (as defined below), or any other user of the BITO Platform and our services.

The term "Services" refers to any services offered by YTORIDE, subject to the terms and conditions applicable to you (available on the BITO Platform), whether on the BITO Platform or elsewhere.

Terms not defined in this Policy have the meanings assigned to them in the terms and conditions applicable to you on the BITO Platform.

Before using the BITO Platform or sharing any Information with us, please read this Policy carefully. This Policy forms part of and is incorporated into the terms and conditions applicable to users of the BITO App on the BITO Platform.

1. USER ACCEPTANCE

By accessing the BITO Platform or using our Services, you agree to and consent to this Policy, including any amendments made by YTORIDE at its discretion and posted on the BITO Platform.

We collect, process, retrieve, transfer, use, store, disclose, and protect your Information in accordance with this Policy and applicable laws, including the Information Technology Act, 2000, and its associated rules ("Applicable Laws"). If you do not agree with this Policy, please refrain from using or accessing the BITO Platform.

By using our services, you confirm the following:

a. The Information you provide to BITO is accurate, up-to-date, and has all the necessary rights, permissions, and consents required to provide such Information to BITO.

b. Providing Information to us and our subsequent handling of it does not violate any agreements, Applicable Laws, charter documents, judgments, orders, and decrees.

c. If you share Information related to other individuals with us, you confirm that you have the authority to do so and allow us to use this Information in accordance with this Policy.

2. DEFINITIONS

Unless otherwise defined in this Policy, the following terms will apply:

a. "Pilots" refer to independent third-party vehicle operators or riders who wish to offer services on the BITO Platform to a user or Customer.

b. "Co-branded Services" refers to services as defined in paragraph 5(c).

c. "Customer" means a person who wishes to receive services from Pilots on the BITO Platform.

d. "Device" refers to a computer, mobile device, or any other device used to access the Services.

e. "Device Identifier" refers to an IP address or other unique identifier of the Device.

f. "Promotion" refers to any contests and promotions offered by us.

g. "Personal Information" includes information that can reasonably identify you, such as your name, email address, and mobile number.

h. "TPSP" stands for a third-party service provider.

i. "Usage Information" is as defined in paragraph 3(II).

3. WHAT INFORMATION DO WE COLLECT?

I. INFORMATION YOU PROVIDE TO US

a. personal Information: We may request you to provide certain Personal Information. This Information is collected through various means and in various places for the provision of Services, including account registration forms, contact forms, or when you interact with us. When you sign up to use the Services, you create a user profile. We collect only such Personal Information as is required for lawful purposes connected with our Services.

b. The Information you provide includes:

Account Information: Creating or updating your BITO account, which may include your email address, name, address, mobile number, gender, date of birth, photograph, login name, password, banking or payment-related information (as permitted by Applicable Laws), and more.

Saved Information: As you use our Services, we may collect and store Information about you to process your requests and automatically complete forms for future transactions. This may include your phone number, address, email address, billing information, emergency contact information, and other relevant details.

Verification Information: If you are a Pilot, we may collect location details, profile picture, call and SMS details, copies of government-issued identification documents, license details, and other details as required for providing Services on the BITO Platform.

Background Check Information: We collect background check and identity verification information of Pilots. This may include information such as driver history or criminal records (where permitted by law) and right to work.

Other Information: We collect additional Information you provide when you correspond with BITO for customer support or report problems for troubleshooting. We also collect Information that you may submit electronically, such as when you use in-app messaging, post on message boards, provide ratings, reviews, or comments. If you refer a friend, we may collect, store, and use your friend's name and contact information to promote our Services.

II. INFORMATION WE COLLECT AS YOU ACCESS AND USE BITO APP

Transaction Information: We collect transaction Information, such as trip details, pick-up and drop-off addresses, distance traveled, payment transaction information, and more.

Location Data:

Pilots: BITO collects location data when the BITO App is running in the foreground or background on your mobile device.

Customers: We collect precise or approximate location data from your Device if you enable us to do so. We use this data to enhance your use of the BITO App, including improving pick-up locations, enabling safety features, and preventing and detecting fraud.

Usage Information: We may use technologies that automatically collect Information whenever you interact with the BITO Platform.

Device Information: We collect Information, including technical information and aggregated usage information, which may contain details like Device Identifier, preferred language, manufacturer, software, device type, operating systems, geolocation, mobile network data, screens visited, touch gestures, scrolling activity, and other actions performed during the use of the BITO App.

4. USE OF INFORMATION COLLECTED

We collect Information to provide you with an enhanced experience when using our Services. We may use the Information we collect for various purposes, including but not limited to:

Enabling access to the BITO Platform.

Verifying your identity and capacity to provide Services.

Monitoring which features of the Services are used most.

Sending service-related announcements.

Preventing, discovering, and investigating violations of this Policy.

Identifying and detecting security breaches, errors, fraud, abuse, and other criminal activities.

Providing your Information to Pilots for service delivery.

Using geo-location information for various purposes.

Complying with Applicable Laws and requests from authorities.

Delivering administrative notices and communication relevant to your use of the Services.

Fulfilling other purposes for which you provide us the Information.

Please note that we do not use the Information collected from you for targeted advertising.

5. HOW AND WHEN DO WE DISCLOSE INFORMATION TO THIRD PARTIES

We do not sell, share, rent, or trade the information we have collected about you, other than as disclosed within this Policy or at the time you provide your Information.

Following are the situations when Information may be shared:

a. WHEN YOU AGREE TO SHARE INFORMATION WITH THIRD PARTIES :

Our platform does not facilitate the sharing of your information with third parties for marketing offers or other purposes. We do not provide links to third-party services within the BITO App, and therefore, we do not disclose your Personal Information to any third parties for such purposes.

b. THIRD PARTIES PROVIDING SERVICES ON OUR BEHALF

We do not engage any third-party service providers (TPSPs) to facilitate our Services. All aspects of our Services are provided directly by our company groups. Therefore, we do not share any information with third-party groups, and your information remains solely within our company groups. This ensures that your Personal Information is not disclosed to any external parties for any purpose.

c. CO-BRANDED SERVICES

We do not currently offer any Co-Branded Services in association with third parties. All aspects of our Services are provided directly by our company groups. Any future introduction of Co-Branded Services would involve sharing your information solely within our company groups, and we would obtain your explicit consent before doing so. This information sharing would be aimed at enhancing your user experience and providing you with new features, all while ensuring your privacy and security.

6. THIRD PARTY CONTENT AND LINKS TO THIRD PARTY SERVICES

While using the Services, you may encounter content provided by third parties. However, we do not utilize any third-party services or integrate third-party content that collects your information. Our commitment to your privacy means that we do not direct you to external sites or applications operated by third parties. Therefore, our Privacy Policy applies exclusively to your interactions with our online and mobile Services, and we do not share your information with any third parties for such purposes.

7. INFORMATION COLLECTED BY PILOTS

This Policy does not cover the usage of any information about you, which is obtained by the Pilots while providing you Transportation, Delivery, Package, or Rentals Services, or otherwise.

8. CHANGE OF INFORMATION AND CANCELLATION OF ACCOUNT

a. You are responsible for maintaining the accuracy of the Information you submit to us, such as your contact information provided as part of account registration.

b. If your Personal Information or Information you provide to us changes, or if you no longer desire our Services, you may correct, delete inaccuracies, or amend information by making the change on our member information page or by contacting us through the email address mentioned on the BITO Platform or contacting the Grievance Officer. We will make good faith efforts to make requested changes in our then-active databases as soon as reasonably practicable.

c. You may also cancel or modify the communications that you have elected to receive from BITO by following the instructions contained within an e-mail or by logging into your user account and changing your communication preferences.

d. If upon modifying or changing the Information earlier provided to us, we find it difficult to provide access to our Services to you due to insufficiency/inaccuracy of the Information, we may, in our sole discretion, terminate your access to the Services by providing you a written notice to this effect on your registered email address.

e. If you wish to cancel your account or request that we no longer use your Information to provide you services, contact us through the email address mentioned on the trip bill received, the BITO Platform, or the Grievance Officer mentioned in this Policy. Please note, we may not be able to provide some or all of the Services in case you disable access to any of your Information as described under this Policy.

f. We will retain your Information, including Personal Information and Usage Information (including geo-location), for as long as your account with the Services is active and as needed to provide you services. Even after your account is terminated, we will retain some of your Information, including Personal Information and Usage Information (including geo-location, trip history, and transaction history) for such a statutory time period as needed to comply with Applicable Laws, to resolve disputes, conclude any activities related to cancellation of an account, investigate, or prevent fraud and other inappropriate activity related to your account, to enforce our agreements, or for other business reasons, etc. After the completion of such a statutory period, your data may either be deleted from our database or be anonymized and aggregated, and then may be held by us as long as necessary for us to provide our Services effectively, but our use of the anonymized data will be solely for analytic purposes.

9. SECURITY

The Information we collect is securely stored within our databases, and we use standard, industry-wide, commercially reasonable security practices such as encryption, firewalls, and SSL (Secure Socket Layers) for protecting your Information. However, as effective as encryption technology is, no security system is impenetrable. We cannot guarantee the security of our databases, nor can we guarantee that Information you supply won't be intercepted while being transmitted to us over the Internet or wireless communication, and any Information you transmit to us, you do at your own risk. We recommend that you not disclose your password to anyone.

10. INFORMATION OF CHILDREN

We do not knowingly solicit or collect Information from children under the age of 18 years. Use of the BITO App is only available for persons who can enter into a legally binding contract under Applicable Laws.

12. CHANGES TO THE PRIVACY POLICY

We reserve the right to update/modify, from time to time, this Policy to reflect changes to our Information practices. Any changes will be effective immediately upon the posting of the revised Policy on the BITO Platform. If we make any material changes, we will notify you by email (sent to the e-mail address specified in your account) or by means of a notice on the BITO App prior to the change becoming effective. We encourage you to periodically review this page for the latest information on our privacy practices. Your use of the BITO App or availing the Services after an updated Policy becomes effective will indicate your acceptance of the updated Policy.
